Effective Immediately - for Mortgage Preparation in the Province of Manitoba.

Form 4180 - All Provinces except Quebec and New Brunswick: Section 3, (c) (iv) should read as follows:

  • For Variable rate mortgages, in the Prime Rate is defined as field of Box 5 of the Mortgage Form, insert "See Details in the Other Details field below"
  • In the Other Details field under the Scheduled Payments option in Box 5 of the Mortgage Form insert the definition of Prime Rate found in section 1 of the Standard Charge Terms, available on our legal forms website

The following General Instructions to Lawyer/Notary will be updated in due course:

In the province of Quebec, La Garantie Habitation des Maîtres Bâtisseurs (GHMB) has been added as an additional new home warranty provider for hypothecs insured by a mortgage default insurer. La Garantie Habitation des Maîtres Bâtisseurs (GHMB) will be added to the following General Instructions to Lawyer/Notary in due course as an approved provider of a certificate of guarantee for new residential buildings:

December 4, 2017

Effective, Monday, December 4, 2017 the following forms have been updated in anticipation of the Manitoba Land Titles Office conversion to electronic registration:

  • 03974 - Manitoba
  • 03975 - Manitoba
  • 03927 - Manitoba
  • 04180 - All Provinces, except Quebec and New Brunswick
  • 03915 - All Provinces, except Quebec and New Brunswick

As a result of these changes,

  1. You must use the form of mortgage that is regulated an approved by the Registrar General or District Registrar pursuant to the Real Property Act (Manitoba) (currently Mortgage Form e6.2); and
  2. Forms 3989 and 3990 are no longer required and will be removed from our Legal Forms website.

Also Effective, Monday, December 4, 2017 the following General Instructions to Lawyer/Notary have been amended to reflect the below changes/additions where applicable:

July 13, 2017

Effective August 1, 2017, the Province of Saskatchewan is implementing a 6% provincial sales tax (PST) on Default Insurance Premiums. Therefore for all default insured mortgages where funds are advanced on or after August 1st the 6% PST payable on the Default Insurance Premiums will be deducted from the advance. Please notify your client of the additional cost to be paid at closing.

Important: If you have already received our mortgage documentation including the Cost of Borrowing Disclosure without indication of the increase, a new Cost of Borrowing Disclosure Statement will be forwarded on or prior to the closing day. If you do not receive a new Cost of Borrowing Disclosure Statement it means your client is not affected by this change.

Effective Monday December 7th. In an effort to enhance the mortgage closing and funding process, the Request For Funds forms #3328 (Residential Mortgages) & #3958 (RBC Homeline) will only be available in PDF format. These forms are editable and fillable electronically. Using the PDF version will aid with the automation of funding and ensures you will receive funds both electronically and earlier on the day of closing.

In addition, we have recently introduced a new toll-free telephone number specifically for our legal community. With this new number, a short menu has been created to ensure your phone calls and inquiries get to the department that can process your request.

The new toll-free number is 1-844-418-9436 and new menu options are as follows;

For Payout Statements and Discharges – # 1
For in Progress Mortgage Transactions, including funding inquiries – # 2
For General Mortgage or Loan Inquiries – # 3

November 30, 2015

As of November 16, 2015, the Ontario Personal Property Security Act (PPSA) was amended and there is no longer a requirement in Ontario for a 5 year maximum registration when registering security against consumer goods under the PPSA; Registrations will now be for the full term of the loan. The General Instructions to Lawyers/Notary form 4180 will be updated in due course. Please review and familiarize yourself with the amendments to the Ontario PPSA.

Alberta Guarantees Acknowledgment Act

Effective April 30, 2015, changes to the Alberta Guarantees Acknowledgement Act will come into force. Due to these changes, individuals providing a guarantee can no longer appear before a notary public and must now appear before a lawyer to acknowledge the terms of the guarantee.

As a result of this change to the law in Alberta, we have updated the following documents which appear on this web site:

– Instructions to Lawyer (forms 4180 and 3915);
– the certificate appearing at the end of the following forms of guarantee:

  • Fixed Rate (form 3936)
  • Prime Rate (form 3937)
  • Guarantee of Residential Mortgage (form 3941)

Please ensure all guarantees executed on or after April 30, 2015, comply with the amended Alberta Guarantees Acknowledgement Act.

Mortgage Specialist Channel only

Early in 2014 we changed the process relating to the execution of the RBC Homeline Plan Agreement from having it signed at the office of the lawyer/notary to having it signed before one of our employees. This change was, in part, a response to feedback from some lawyers/notaries who indicated the signing of the agreement was not a necessary part of the mortgage process. After the process change, we received requests from many lawyers/notaries for copies of the signed agreement to assist with the disbursement process. As a result, we provided copies of the agreement to lawyers/notaries, on request. Providing copies based upon request is an inefficient process for both the firms and us. Based upon your feedback and the number of requests we have received, effective February 2nd, 2015 we will revert back to the previous process. The unsigned RBC Homeline Plan agreement will be included with the document package and you will be instructed to have the document signed and returned to us along with the report on title/security.

August 20 2014

Effective Aug 20th, 2014: RBC has discontinued the RateCapper mortgage from our available suite of products to align to Canadian Banking strategic priorities to do things simpler, faster and better.

The product will no longer be available for acquisitions, renewals, refinance and port transactions. For pipeline RateCapper applications initiated prior to Aug 20th, 2014 RateCapper documents (i.e. Standard charge terms) will be available until May 2015.

Alberta New Home Buyer Protection Act

The Alberta New Home Buyer Protection Act (the "Act") came into force on February 1, 2014. If applicable, obtain the Warranty Certificate required under the Act. Retain the Warranty Certificate in your file. Our Instructions to Lawyers (Form 4180) will be updated in due course.

Effective July 1st, 2013, the Province of Manitoba is increasing the provincial sales tax rate from 7% to 8%. Therefore, all applications closing on July 1st and after will be charged an 8% tax applicable on Default Insurance Premiums. Please notify your client of the additional cost to be paid at closing.

Effective July 15th, 2012, the Province of Manitoba is introducing 7% RST on Default Insurance Premiums. The RST is applicable to all Default Insured Mortgages closing July 15th 2012 and after. Please notify your client of the additional cost to be paid at closing.

Important: If you have already received our mortgage documentation including the Cost of Borrowing Disclosure (COB) without indication of the sales tax, please note we will be issuing an Amendment to the Disclosure prior to the closing day with the sales tax amount included.

Information Re: G20 Summit

For lawyers/notaries outside of Québec…

As you are aware, the G20 Summit is being held in downtown Toronto over the period June 24-28. To prepare for possible disruption in accessing our premises in Toronto , we will be invoking our business continuity plans which involves making use of additional space outside of the core area. To ensure that none of our legal partners nor our mutual clients are adversely impacted, we ask your assistance in our preparations.

For any transactions scheduled to close during the above period, please submit your Request For Funds complete with trust account information for any Financial Institution ASAP, but no later than June 21. We wish to program electronic disbursements in advance of the closing date for all transactions. For closings June 29 - July 2, please request funds by June 24 if possible.

Should you be aware of a transaction closing during the period and we have not contacted you nor provided our instructions a week in advance, please contact the following Mortgage Closing Officer lines to investigate:

Effective December 23rd 2009, RBC Royal Bank will implement amended Cost of Borrowing Disclosure Statements/Agreements to comply with the Federal Cost of Borrowing (COB) regulations that takes effect January 1st, 2010. Several changes have been made to the first three pages of these documents to capture changes permitting the first advance to be used to purchase land or withdraw equity from owned land. When the first advance is used for this purpose, the construction/mechanics lien does not apply. We anticipate having full national deployment of our RBC Express ACH Direct Deposit funding solution by early 2009.

New Mortgage Assumption Procedures for Prospective Home Purchasers In Alberta

Effective February 29, 2008, all prospective home purchasers in the province of Alberta who wish to assume an existing RBC Royal Bank® residential mortgage must be qualified and approved through RBC Royal Bank's standard mortgage application process.

Through the standard credit application process, an experienced and knowledgeable mortgage specialist can guide the prospective home purchaser - answering questions, providing financial advice, and ensuring that the client is aware of and understands the terms and conditions of the mortgage they are assuming.

The seller also benefits from the change too - they can now be released from the mortgage on a property they no longer own, once the proposed purchaser is approved through the credit application process.

This change allows RBC Royal Bank to meet the anti money laundering regulatory requirements and ensures any existing mortgage default insurer’s policies, that may be in effect, are met. Opportunities for fraud will be reduced and potential fraudulent mortgage applications will be more easily identified. This will bring Alberta in alignment with the rest of Canada where full credit applications are completed for all RBC Royal Bank mortgage assumptions.

Several Changes

Approval of Mortgage and Cost of Borrowing Statement of Disclosure

Effective October 24th, 2007, all Approval of Mortgage and Cost of Borrowing Statement of Disclosure documents have been rewritten to make the documents easier to understand and review. We will continue to mail or fax the documents to you.

Lawyers Website For Payout Statement changes

Effective October 9th, 2007, Royal Bank of Canada will introduce redesigned Payout, Information and Assumption statements for Residential Mortgages, and RBC Homeline Plan® mortgage segments. Some of the changes are highlighted below:

  • Payout funds must be received within 5 calendar days after the effective date of the Payout Statement for all provinces excluding Quebec or the statement will be null and void;
  • The Payout Statement will indicate that the lawyers/notary is required to retain an amount equal to the regular payment amount for 10 calendar days after the payout funds are remitted. This requirement has been added due to the fact mortgagors from time to time fail to make the last payment prior to the payout date. If the final payment is not received, a discharge of the mortgage cannot be processed;
  • Information statements are not valid for payout, transfer or assumption purposes, and are only valid on the day of issue;
  • Assumption statements will provide confirmation if the current mortgage is delinquent, and the amount of the arrears required to be paid by the vendor. The arrears must be paid as a condition of the processing of the assumption of the mortgage.

The notary, not the Bank, is responsible for maintaining the holdback for legal hypothecs of persons who took part in the construction or renovation of an immovable. RBC has launched the Conveyancing Protocol for British Columbia, Alberta, Saskatchewan and Manitoba. RBC will extend this Protocol to include RBC Homeline Plan and Collateral Mortgages at a date to be determined. PAYOUT STATEMENT REQUESTS

Effective immediately, when a residential mortgage payout statement request is received earlier than 10 calendar days prior to the closing date, RBC will fax an acknowledgement to the originator, indicating a date on which the request will be completed.

The faxed documents are to be used in lieu of original documents.
