Verbal Consent Confirmation for your RBC Mortgage Account
This is to confirm our conversation regarding your decision to receive Information about your RBC Mortgage Account in electronic form only.
The following agreement and consent (this “Consent”) will govern the electronic delivery of your Information to you, unless you have agreed to the terms of the new Electronic Access Agreement after May 29, 2019 (“New EAA”). In that case, please see Part 1 of the New EAA for the terms and conditions that govern the electronic delivery to you of Information. You can find the New EAA under the “Legal” link, located at the bottom of the page in Online Banking and under the “More” menu in Mobile Banking.
You consent to receive Information by electronic delivery in Online Banking and Mobile Banking (if available) only and hereby designate Digital Banking as your designated information system for this purpose, subject to the following terms and conditions:
- Definitions.
In this Consent:
“Digital Banking” means our Online Banking and Mobile Banking services;
“Information” means monthly or periodic account statements, disclosures, notices (including changes to your RBC Mortgage Account and changes to fees or interest rates applicable to your RBC Mortgage Account), confirmations, certificates, terms and conditions, agreements and amendments to your RBC Mortgage Account or other information we may be required or permitted to send to you now or in the future under legislation for your RBC Mortgage Account.
“Message Centre” means our online communication centre located in Online Banking where information may be securely communicated between you and us.
“RBC Mortgage Account” means your RBC mortgage account that we have opened in your name or in your name and the names(s) of another borrower or borrowers for which you have selected electronic Information.
“You” and “Your” mean the individual who is enrolled to access this Online Banking service and who is a borrower on the RBC Mortgage Account and “ we”, “us” and “ our” mean Royal Bank of Canada.
Terms not otherwise defined in this Consent will have the definitions set out in your Electronic Access Agreement.
- When Consent Takes Effect
Your consent to receive Information by electronic delivery takes effect immediately, though you may still receive some Information in paper form for a limited time (for example, you may receive one or more RBC Mortgage Account statements in the mail depending on your statement date).
- Electronic Delivery of Information
- You will receive Information in your documents page in Digital Banking or in your Message Centre in Online Banking (and Mobile Banking, if available), rather than in paper and electronic form.
- When new Information in electronic form is available for you to access, we will send a message to your Message Centre. We may also send you an email (but only if you have provided us with your email address) to notify you that Information is available through Digital Banking.
- Please note that email communication is not secure or reliable and email notifications may not be received by you in a timely manner or at all. We will not be responsible to you for any damages or costs resulting from your failure to receive an email notification. You may opt-out of email notifications by changing your email preferences in Online Banking.
- Your Information is deemed to be delivered to you on the day that it is made available to you through Online Banking and not on the day that you actually access it.
- You understand and agree that:
i. you must access Online Banking to access your electronic Information and agree to do so on a regular basis but in any event, not less than once every thirty (30) days;
ii. you will advise us of any changes to your contact information that you have provided in connection with Digital Banking, including any change in your email address;
iii. choosing to receive email notification does not change your obligation to access Online Banking to access your electronic Information; and
iv. we will not be responsible to you in any way for any damages or costs incurred by you as a result of your failure to: (i) receive an email notification, (ii) access your electronic Information, or (iii) pay any amounts owing as indicated on your electronic Information, including, but not limited to, any interest you may have to pay.
- Technical Requirements. All electronic Information is presented as PDF files and require you to have Adobe‡ Reader‡ software installed on your Device. We do not own or operate, and are not responsible for, Adobe Reader software.
- Availability of Electronic Information.
- Electronic Information will be available for up to 7 years as long as your RBC Mortgage Account remains open, you continue to be enrolled in Digital Banking and your delivery preference continues to be electronic form only.
- Information in electronic form sent to the Message Centre will be available for up to 90 days from the date we first notify you in the Message Centre, unless the Information is deleted by you. Information in electronic form sent to your documents page in Digital Banking will be available for up to 7 years.
- It is your responsibility to retain a copy of your Information by printing or saving it while it is available to view in Online Banking or Mobile Banking (if applicable). We can provide you with a paper copy of any Information that you have received electronically at our standard fee, if applicable.
- Other Agreements Continue to Apply. Any agreements applicable to your RBC Mortgage Account continue to apply. You are required to review all of your Information in accordance with the provisions of the agreements applicable to your RBC Mortgage Accounts, and if you think there is an error, you must contact us as set out in those agreements.
- Document Options. You or any co-borrower on the RBC Mortgage Account can change the preference from electronic to paper Information for the RBC Mortgage Account at any time by contacting any RBC Royal Bank Branch or Royal Direct at 1-800-769-2511. You or any co-borrower on the RBC Mortgage Account can also make this change by clicking on the “Statements & Regulatory Documents” link in Online Banking or on the “Statements” link under “Settings” in the “More” menu in Mobile Banking.
- Provision of Paper Information. We may provide you with Information in paper form if we are unable to provide it to you electronically, or otherwise at our discretion. Not all Information is currently available from us electronically. Information not currently available from us electronically will continue to be sent to you in paper form only until we begin to offer it electronically. - Changes to this Consent. We may change the terms of this Consent, by providing you with written or electronic notice, including by providing you with notice (i) in the Information sent to your documents page in Digital Banking, (ii) in the Message Centre or otherwise in Digital Banking, or (iii) sent to the email address you last provided via Digital Banking or to your mailing address last appearing on our records. If you access Digital Banking after being notified of the changes to this Consent and those changes have come into effect, you are deemed to have reviewed and accepted those changes.
- Electronic Information is not part of the Document Presentment Service. The electronic delivery of your Information is separate from the Document Presentment Service described in your Electronic Access Agreement. The terms and conditions of the Electronic Access Agreement regarding the Document Presentment Service do not apply to the electronic delivery of your Information.
- Other Agreements. This Consent applies in addition to any other agreement you have entered into with us, which continue to apply.
- Language. You and we have expressly requested that this Consent and all related documents, including notices, be drawn up in the English language.
